AUSTIN — Educator groups fear a new Texas law requiring nearly all public school employees be fingerprinted as part of an extensive criminal background check may rid schools of otherwise good teachers who committed minor offenses in their youth. Beginning Jan. Currently, only teachers certified since have had to undergo the extensive background reviews, including fingerprinting.
An estimated 1 million public school employees will be affected by Senate Bill 9 between now and , the deadline for districts to be in compliance. The background checks will be rolled out district by district, beginning in Austin. State officials are keeping the roll-out schedule under wraps, Phillips said, to prevent employees with something to hide "from skipping from district to district.

Officials with the Houston Independent School District, the state's largest, said they don't expect the new law to have a major impact. Although the district currently does not require non-teaching employees to be fingerprinted, it already runs national background checks on applicants, plus annual checks on current employees, district spokesman Terry Abbott said.
Abbott said he doesn't expect the new checks to reveal unknown criminal problems with the district's 30, or so employees. Most districts now conduct state background checks through the Texas Department of Public Safety , which can't check databases nationally. According to the TEA's Phillips, 66 certified public school teachers across Texas have been found to be registered sex offenders since , though none was working in the public schools.
Some teacher applicants were found to have had serious offenses on their records.
The state will cover the cost of the background checks for certified full-time educators employed in a public or charter school in the school year.
